Is the Trump Administration’s Federalization of DC Police a Precursor to Martial Law?
As everyone has likely heard by now, President Donald Trump has decided to federalize the Metropolitan Police Department of the District of Columbia (MPDC) to deal with a declared emergency pertaining to a crime wave that has apparently hit the area. The mantra seems to be: “Our capital city has been overtaken by violent gangs and bloodthirsty criminals, roving mobs of violent youth, drugged-out maniacs and homeless people, and we’re not going to let it happen anymore.” Since Washington, District of Columbia (DC) technically falls under the jurisdiction of Congress, the president is permitted to execute any laws that the legislature has enabled under the Constitution’s Article I Section 8 Clause 17, which states that Congress has the power “To exercise exclusive Legislation in all Cases whatsoever, over such District (not exceeding ten Miles square) as may, by Cession of particular States, and the acceptance of Congress, become the Seat of the Government of the United States.”
In order to federalize the police department, the president must invoke Section 740 of the District of Columbia Home Rule Act, which is the 1973 law that has allowed the city to establish its own local government without much federal oversight. Since the president is only permitted to enact this provision without congressional approval for thirty days, provided he sends notification to leaders of congressional committees, this is supposed to be a short-term action. However, as with anything involving the federal government, this precedent will most likely become more permanent and potentially spread to other cities across the country. The president already said that he plans to ask Congress for an extension of the federalization of the MPDC.
In addition to ridding the city of crime and removing homeless people (including veterans) “FAR from the Capital” and out of encampments and into mental health and addiction facilities against their will (he has recently enacted an executive order to get states to clean up homeless people from the streets as well), the National Guard, and possibly the active-duty military, will be deployed, bolstered by the West Virginia National Guard (Tennessee, Mississippi, Louisiana, South Carolina, and Ohio are in the process of following suit, and this may begin a trend), to assist these federal police agents. The Trump administration will also get assistance from the Secret Service, the Federal Bureau of Investigation (FBI), and the Drug Enforcement Administration (DEA), and the head (administrator) of the DEA, Terry Cole, was planned to become the interim leader of the MPDC (Police Chief Pamela Smith will now stay in her post, but Cole will still oversee the operation).
Stripping away local government from people and putting more control into the hands of the federal government is a bad move, especially when conservatives back this but also cry that the government is too big. In fact, it is conservatives that advocate for more local control of government and less federal intervention, at least when they are not in charge. What justification is there really for doing this in the first place?
Even though DC (currently under the leadership of Mayor Muriel Bowser) has a higher crime rate than all fifty states and is the fourth worst city in the country for homicides, crime is actually down in the city in the year 2025, and it has also decreased thirty-five percent from 2023 to 2024. Even according to Fox News, homicides are down thirty-two percent, robberies by thirty-nine percent, armed carjackings by fifty-three percent, and assaults with a dangerous weapon by twenty-seven percent. These reports come directly from the Department of Justice, so if Attorney General Pam Bondi and President Trump wanted to alter the numbers to make it look more like a dire situation, why would they release these statistics? Instead, it is universally accepted that crime has decreased in the United States over the last couple years, so why, then, does a crime emergency need to be declared? Why was it not an emergency over the last few years or months when crime was higher?
The actual answer comes down to power and the desire to beautify the city ahead of dignitaries coming to visit. It is ironic that conservatives slammed California Governor Gavin Newsome for clearing homeless camps in San Franscisco prior to the arrival of President Joe Biden and Chinese President Xi Jinping, but now, those conservatives are cheering this on when President Trump does the same type of move in the American capital city. Despite the hypocrisy, the more concerning part of this is the emergency declaration and the deployment of troops.
Have we forgotten that just a few years ago Democratic governors, in particular (though Republican ones did so as well), were declaring emergencies for a virus with a tiny casualty rate and disrupting our everyday lives because people were afraid? Well, as part of this new emergency on crime, President Trump declared, “You want to be able to leave your apartment or your house where you live and feel safe and go into a store to buy a newspaper or buy something, and you don’t have that now.” He is appealing to the same type of emotions that brought us the COVID-19 lockdowns and the “you want to kill grandma if you leave your house” logic (except that he is playing the reverse in that you cannot leave your house because it is too dangerous out in the world). Allowing for arbitrary declarations of emergencies so that the executive branch can gain more power is not only the oldest trick in the authoritarian playbook, but it is also not something that the people should permit in a free society.
We should not want a city in the United States to have a standing army roaming the streets to rid us of crime. Yeah, it may make people feel safer, and it may even drive crime down, but there is a cost to our individual liberties when troops can invade our homes, patrol our streets, or stop us at any time under the guise of preventing crime. Our founding fathers warned us about this type of police deployment, as they suffered under something similar when British troops patrolled their cities (Boston, in particular). They considered it tyranny, and yet, many cheer this on today because they have been propagandized into believing that more government control will solve our issues.
There are already rumors that President Trump may deploy the National Guard to or even federalize local law enforcement in other large cities across the country, which could include New York City, Chicago, Baltimore, and Oakland. Though the president has no authority to direct local police departments or the National Guard to enforce state laws, he may try to bypass the Posse Comitatus Act and invoke the Insurrection Act to federalize states’ National Guard units and enforce federal law. However, without a rebellion or insurrection, he would have a difficult time justifying such action, so without a violation of federal law and the Constitution, it would not be likely that he could pull off what he is doing in DC. Though, if there is a false sensation of safety and others around the country begin to want the federal government to intervene to prevent crime, the people may actually beg for it. In that case, the president would be more than happy to oblige. This may then set the precedent for implementing martial law and deploying the military to any neighborhood near you, and is this really what you want?
It may be tempting to believe that sending more police is the answer, and perhaps Democratic governors and mayors, as well as the Joe Biden administration, encouraged crime to wreak havoc, but remember that once you allow the federal government to send law enforcement to domestic cities, it will never go back to where it once was. Little by little, you will become conditioned to accept that as normal, and down the road, the United States will transform into a police state. You may be on the side of the power for now, but what happens when a Democrat ascends to the American throne? What if the new president decides that he or she wants to declare an emergency on guns and rolls through the streets of small towns across the country to round them up, or what if the federal government goes after dissidents and those who speak out against the current administration? Would you be fine with a president of the opposing party using the same powers that President Trump is invoking? You need to think of these things in these terms, because when you cry that a future president is abusing power, you will not have much of a leg to stand on if you cheer on what the current administration is doing now.
For years, conservatives and conspiracy theorists were worried that the federal government would declare martial law in cities and throw dissidents into concentration camps, and yet, when President Trump makes moves in that direction (including putting illegal immigrants in camps as a precedent for citizens to be next), they forget about the years of predictions and concerns and throw all of that away in exchange for increased federal government control. It is astounding, but it also shows that both parties are the same and unprincipled.
Moreover, it almost makes it appear that the powers that be and global elites have found a way to make even the most ardent of conspiracy theorists cave to the system. President Trump was the key in gaining compliance among those who would otherwise have potentially sparked a rebellion. Now, liberals and Democrats will become the dissidents until the next great switcheroo. This tactic keeps the people divided and never united against their common enemy. Alex Jones and The Young Turks should be on the same page about opposing the tyranny of deploying federal troops for domestic law enforcement, and yet, they are not. The system is working exceptionally well for the purpose of driving the global agenda, and soon enough, the federal government will be given the power to operate agents openly in our cities. At that point, will we cheer on the police state, or will we rise up against these “British troops” like our founding fathers did?
